Suspect Intercepted at Cyril E. King Airport
A convicted California sex offender was intercepted by federal authorities at the Cyril E. King Airport on St. Thomas as he attempted to board a flight back to the mainland after living in the territory undetected for six months, court records show.
Kenneth Earl Burford, 75, was arrested on Tuesday, August 11, 2026, and charged with failure to register as a sex offender under Virgin Islands law.
Busted by Customs During Departure
According to a probable cause fact sheet filed in V.I. Superior Court by Special Agent Kenneth Arthur of the V.I. Department of Justice, Burford was attempting to board a flight bound for Sacramento, California, on July 18, 2026, when he was flagged and questioned by U.S. Customs and Border Protection (CBP) Officer Andrew Fisel.
During the interview, Burford admitted to the federal officer that he had been living on St. Thomas for the previous six months without ever registering his presence with local law enforcement, as mandated by territory statutes.
Court records indicate Burford detailed his stay across three separate St. Thomas locations:
- Emerald Beach Resort (13 days)
- An apartment on Raphune Hill (13 days)
- A residence at 55A Estate Contant (for the remainder of his stay)
Burford told authorities he had originally moved to the territory with the intent to relocate permanently before changing his mind and deciding to return to California.
1987 Oral Copulation Conviction
Under Virgin Islands Code (14 V.I.C. § 1722), any individual convicted of a covered sexual offense in any U.S. state or territory who establishes residency, employment, or stays in the Virgin Islands is required by law to register with the V.I. Department of Justice.
Background checks revealed that Burford was convicted in California on December 2, 1987, of oral copulation with a minor under the age of 16 (California Penal Code § 288). Because Burford was over the age of 21 at the time of the offense, he remains subject to lifetime sex offender registration requirements.
Facing Felony Charges
Burford has been formally charged in the St. Thomas-St. John District under case number ST-2026-CR-00196 with failure to register as a sex offender (14 V.I.C. §§ 1722(a–d); 1730(a)).
Court filings indicate Burford had no prior criminal record on file within the territory prior to this arrest—but local authorities rely on statutory compliance—and Burford’s failure to report now carries formal felony charges in Superior Court.
